Terms and Conditions

  1. 1. Who Are We?
    1. 1.1. The Competition is offered to you by Carlton Books Limited. Our registered office is at 20 Mortimer Street, London W1T 3JW and our company registration number is 02625229 (referred to in these terms and conditions as "Carlton", "we" or "us").
    2. 1.2. For the avoidance of doubt, Google Inc does not, and/or any of its subsidiaries or related companies do not, have any role in the Competition.
    3. 1.3. You can enter the Competition via our website at www.jointhetreasurehunt.com (the "Website").

  2. 2. What terms, conditions and rules apply to the Competition?
    1. 2.1. These terms and conditions ("Terms") apply to the Competition. Any persons who breach them may be excluded from access to the Competition.
    2. 2.2. Instructions about using the clues embedded in The Great Global Treasure Hunt On Google Earth™ (the “Book”) in order to locate the buried treasure (although it may not be actually buried) and enter the Competition appear on the flysheets of the Book and those instructions form part of these Terms.
    3. 2.3. The following general terms also apply to the Competition:
      1. (a) entries are restricted to one entry per person;
      2. (b) entries must be received between 11:59pm GMT on 1 September 2011 and midnight GMT on 31 March 2012 (the "Competition Period"). Any entries received before or after this period will not be entered;
      3. (c) if you are under 18, you must have the consent of your parents or legal guardian to take part in the Competition; and
      4. (d) employees of Carlton (and their family members) or any company involved in the Competition are excluded from entering and any entry will not be considered.
    4. 2.4. In the event of any fault, misunderstanding, mistake or dispute concerning the operation of the Competition, including the correctness or acceptability of any answers given by the Winner, or the operation of any technical/communications system, our decision shall be final.
  3. 3. How do I enter the Competition?
    1. 3.1. To enter the Competition you must register free of charge (no purchase of the Book is necessary) on the Website by entering your name, email address, address, phone number, and country of residence and correctly state the physical location of the treasure, as revealed by the clues provided in the Book.
    2. 3.2. The location of the treasure must be clearly stated using Google Earth™’s “decimal degrees” format, using four decimal places, including all zeroes, and using the minus sign notation instead of entering a “N”, “S, “E” or “W”. For the avoidance of doubt, the format is: -##.####, -###.#### where:
      1. (a) the co-ordinate before the comma is latitude, and after the comma is longitude;
      2. (b) each “#” must appear, and be replaced by a digit from 0 to 9;
      3. (c) the first “-” (minus) sign is only included if your answer is South of the Equator;
      4. (d) the second “-” (minus) sign is only included if your answer is West of Greenwich London; and
      5. (e) you must include the comma and the space.
    3. 3.3. An example answer that follows the correct format would be “51.5182, -000.1391”, which are the co-ordinates for the address of Carlton set out in Term above. Note that all zeroes are included and only that exact string of characters (without the inverted commas) would be the correct answer.
    4. 3.4. The entry form on the Website is set up with an input mask that follows the correct format, however it remains your responsibility to enter an answer that complies with the method and provides the geographical reference terms set out in Term above.
    5. 3.5. Google Earth™ accepts more precision than four decimal places. Four decimal places equates to an area of a few square metres, although the uncertainty decreases for co-ordinates further from the equator. For example, the co-ordinates set out in Term describe an area of approximately 77m2 (seventy-seven square metres). This imprecision is deliberate. The treasure need only be located inside the area that your co-ordinates describe.
    6. 3.6. Answers which purport to give the location of the treasure using any other method, language, co‑ordinates or reference terms will not be accepted.
  4. 4. Winner Selection
  5. A single winner will be selected at random from the entrants who have correctly entered the location of the treasure in the manner we require, under the supervision of an independent overseer (the "Winner").
  6. 5. Prizes
    1. 5.1. The prize for the Competition is a single prize of €50,000 (fifty thousand Euros) (the "Prize").
    2. 5.2. Carlton will notify the Winner by email no later than 5:30pm GMT on 30 April 2012.
    3. 5.3. The Winner's name and country of residence will be announced on the Website at the same time as the Winner is notified.
    4. 5.4. If no entrant submits the correct answer, an announcement saying so will be made on the Website by 5:30pm GMT on 30 April 2012, together with the correct answer.
    5. 5.5. The Prize will be made available to the Winner no later than 5:30pm GMT on 30 April 2012.
    6. 5.6. Subject to compliance with any applicable money laundering regulations, bank account opening procedures, foreign currency exchange rules and other such financial requirements, the Prize will be payable to the Winner by either bank transfer to any bank or building society account or by a cheque made payable to a recipient specified by the Winner.
    7. 5.7. Carlton will not be liable if the Prize fails to reach the Winner, or the Winner cannot take the Prize for reasons beyond our control, or delivery of the Prize is delayed.
    8. 5.8. No alternative prizes will be given and the Prize is non-transferable and non-exchangeable.
    9. 5.9. It is the responsibility of the Winner to pay any and all applicable taxes on the Prize.
    10. 5.10. We reserve the right to verify the Winner's eligibility and to verify to our satisfaction his or her identity. Failure to provide proof of identity satisfactory to us within a reasonable period of our request shall entitle us to delay the award of the Prize or disqualify the Winner from the Competition and select another Winner to receive the Prize. All personal details and information must be truthful and accurate.
    11. 5.11. We reserve the right to disqualify any person from the Competition and/or withdraw any Prize should they at any stage supply any untruthful, inaccurate or misleading personal details and information.
  7. 6. What if my entry is lost or damaged? If we do not receive an entry from you for the Competition then we cannot enter you, regardless of whether you submitted the entry to us. Also, if we receive an entry from you that is incomplete or otherwise deficient, for example an answer that does not comply with the method and provide the geographical reference terms set out in Term above, we may not be able to enter you. We will not accept proof that an entry was entered as proof that we received it.
  8. 7. How far are we liable or responsible to you?
    1. 7.1. Nothing in these Terms removes or limits our liability for fraud, death or personal injury caused by our negligence or for any liability which cannot be limited or excluded by the law. These Terms also do not affect the rights that are granted to you as a consumer by the law. Otherwise, we will not be liable to you for any matter relating to the Competition.
    2. 7.2. For the avoidance of doubt, the clues in the Competition may be solved exclusively using Google Earth™ and no advantage will be gained by physically visiting any location. We will not be liable if you attempt to do so.
    3. 7.3. We will also not be liable to any person for financial loss or inconvenience because of the failures of persons or systems that we do not directly control – for example, mobile phone network operators, internet service providers, postal services, software providers and telephone traffic handlers.
  9. 8. Confidentiality
    1. 8.1. You undertake not at any time to disclose, reveal, communicate or otherwise make public any confidential information relating to Carlton, its business, personnel, servants, agents or officers or to anyone.
    2. 8.2. You hereby agree that you shall not divulge to any party, any trade secret, confidential information, or generally any information concerning the business or finances of Carlton, or any of their dealings, transactions or affairs of which you shall come to know unless required by law or unless such information is already in the public domain. In addition, you agree and acknowledge that you shall not (except as required by law or unless such information is already in the public domain) at any time hereafter, either personally, or by means of press or publicity or advertising agencies, divulge or disclose any information of any nature or kind relating to the development or production of the Competition, or make any statement or announcement or disclosure, or supply any information or photographs, to any person or to the public, relating to any matter arising hereunder, coming within your knowledge by reason of your participation in the Competition.
  10. 9. How will we use your personal details?
    1. 9.1. Carlton will use your personal information for the purpose of:
    2. (a) operating the Competition and processing your Competition entry; and
    3. (b) posting your name and country on the Website should you win the Competition; and
    4. (c) dealing with any enquiries or complaints.
    5. 9.2. Where we want to use your personal details for purposes other than those in Term above (such as publicity surrounding the Competition) we will offer you the opportunity to agree or to refuse this.
    6. 9.3. Your personal information will be treated in accordance with our privacy policy (which can be found on the Website) from time to time and in accordance with the law as it relates to people’s personal information.
  11. 10. The legal position of these terms and conditions
  12. 10.1. These Terms form a legally binding agreement between you and us. We reserve the right to change them and update them from time to time but if we do so we will post the changes on the Website.
  13. 10.2. These Terms shall be governed by English and Welsh law and are subject to the exclusive jurisdiction of the courts of London, United Kingdom.
